Abstract

This research aims to address the question of whether the philosophy of Islamic law is merely a theoretical exploration of the virtues, advantages, and wisdom of Islamic legislation, or if it represents a universal spirit within the law that seeks to achieve objectives and purposes that can be actualized in constructing a comprehensive vision with implications for human actions and their outcomes, ultimately fulfilling the purpose of human existence. This exploration is based on the intellectual contributions of the eminent scholar Mustafa al-Zalmi (may Allah have mercy on him) regarding the philosophy of Islamic legislation and its objectives.


The Islamic Ummah, for which Allah Almighty has ordained ease and expansiveness, has been blessed with the guidance of esteemed scholars and jurists, chosen to distinguish the authentic from the inauthentic and to differentiate the sound from the unsound.


Thus, both the prophetic tradition and the philosophy of Islamic legislation remain preserved and protected from distortion and forgery. In this way, Allah Almighty has safeguarded the sources of legislation after His concise and exalted words, employing trustworthy and just scholars to serve and preserve the noble Sharia, elucidating the objectives and purposes found within the pure Sunnah and Islamic law. Among these scholars is the esteemed Imam Mustafa al-Zalmi (who dedicated himself to the Sunnah of the Messenger of Allah.
