Marrying off a Girl with a Dowry Less than That of Counterparts (Mahr-Al Mithl) in Islamic Jurisprudence and Iraqi Law- A Comparative Study

Abstract
Islam religion develops more social relation such as wife and spouse, families and society. These countries are Muslim like our country (Iraq) over the man and the lady accepts each other then go to preacher or court to marry. This study describes process of marriage in terms dowry. Paying lake of dowry like) Mahr Al-Mithl) has compared between law of Islam and law of Iraq. The Scholars of Islam under light of the holly Qur'an focus more on process of marriage, also Iraqi Personal Status Law as well. In the past (Jahilat) the father violate right of his daughter s' dowry but Islam backed dignity right of women before 14 century. Dowry is a right and provided by Allah for women no one violate this right. Dowry is dependable not limited according to deal between both families. For example, a period of time is now in the court of Hebib, governorate of Diyala- Iraq a boy and girl signed process of marriage and their dowry only a bunch of flower not more, women are free how much they have got but Islam calls make facilitate in dowry. So Prophet Mohammed (Peace upon him) says marriage is a productive process and easy dowry. Unfortunately, many women believe that high dowry keeps from divorcing by spouse and believed low dowry decrease their personality and reputation. The courts announced rate of divorce between wife and spouse are not related to low and high dowry rather related to believe, love, respectful, loyalty, ethics.
