الملخص
يهدف البحث بيان اهمية المصلحة في التشريع الاسلامي والنظر في مناسبتها في ضوء مقاصد الشريعة إذ ان نفعها يعود لعموم الامة كما ان المصلحة راعت الأعراف واهتمت به ونبهت على خطورة المآلات ايضاً . إذ لا تقوم المصالح على اساس التلذذ وسوء التدبير العقلي والنظري وليس فيها ايضا تعطيل للمصالح الانسانية في الدنيا والاخرة بل تقريرها ، فكانت دراستي بيان تطبيق المصالح المنطوية تحت الاعراف والنظر في المآلات بما يحقق نفع الامة الاسلامية .
