الملخص

إن إزهاق النفس البشرية المسلمة من أبشع الجرائم في نظر الإسلام، ومن السبع الموبقات التي يترتب عليها استحقاق العقاب في الدنيا والآخرة، لذلك شرع الله القصاص ممن تسول له نفسه ارتكاب مثل هذه الجريمة البشعة انتقاماً منه وزجراً لغيره، وتطهيراً للمجتمع من الجرائم التي تزلزل أمنه واطمئنانه فقال تعالى: {يَا أَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى الْحُرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ وَالأُنْثَى بِالأُنْثَى فَمَنْ عُفِيَ لَهُ مِنْ أَخِيهِ شَيْءٌ فَاتِّبَاعٌ بِالْمَعْرُوفِ وَأَدَاءٌ إِلَيْهِ بِإِحْسَانٍ ذَلِكَ تَخْفِيفٌ مِنْ رَبِّكُمْ وَرَحْمَةٌ فَمَنِ اعْتَدَى بَعْدَ ذَلِكَ فَلَهُ عَذَابٌ أَلِيمٌ}


فالآية الكريمة تدل دلالة واضحة على فرضية ومشروعية القصاص في النفس على جميع المؤمنين، لأن كتب بمعنى فرض وشرع كما قال العلماء.


وقال تعالى: {وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ وَالْعَيْنَ بِالْعَيْنِ وَالأَنْفَ بِالأَنْفِ وَالأُذُنَ بِالأُذُنِ وَالسِّنَّ بِالسِّنِّ وَالْجُرُوحَ قِصَاص}


وهذه الآية أيضاً تدل على وجوب القصاص على جميع المسلمين ومن يسكن ويقيم في دارهم من الذميين والمستأمنين، في النفس وما دونها، لأن كتبنا بمعنى أوجبنا.


ويقول صلى الله عليه وسلم في حديث عبد الله بن مسعود رضي الله عنه: "لا يحل دم امرئ مسلم يشهد أن لا إله إلا الله وأني رسول الله إلا بإحدى ثلاث النفس بالنفس، والثيب الزاني والمارق  من الدين التارك الجماعة".


وقد أجمعت الأمة الإسلامية على وجوب القصاص على الجاني عمداً في النفس وما دونها ؛ وعلى هذا الاساس تمت دراسة مسائل القصاص .
