The Rule of Advocate of Nature Compensates the Constrain of the Law and Its Impact on the Orders and Prohibitions of the Law and the Jurisprudence of the Scholars
Main Article Content
Abstract
Allah Almighty has set the glorious Shari’a to the fullest extent required by the needs of the taxpayers in the immediate and the future, taking into account their conditions and what they are innate with in terms of morals and temperaments, and among its virtues and subtleties in its commands and prohibitions. He forbids anything of what our nature predicts, forbidding prohibition and obligating to suffice with the natural deterrent, and all of this confirms the saying of Allah. In this research, I will shed light on this proportionality through the aforementioned rule, showing its impact on legal orders and prohibitions, as well as on the actions of the honorable scholars and their jurisprudence.
