Facilitation at Al-Nawawi through His books Al-Minhaj and Al-Majmoo’ Al-Ibadat as a Model: An Analytical Jurisprudential Study
Main Article Content
Abstract
This paper aimed to mention the jurisprudential facilitation of Imam Al-Nawawi, relying on the most honorable book in Shafi’i jurisprudence called (Al-Majmu` fi Sharh Al-Muhadhab) by Imam Al-Shirazi. This following did not prevent him from taking an opinion other than his adopted school of thought in some issues, and choosing what evidence aligns with him. The text testifies to him, even if that choice and facilitation were in contradiction to the doctrine. In his study of the issues he mentioned, the researcher tried first to give a clear picture of the issue. Then, he mentioned the sayings of jurists and scholars about the issue, with their evidence that they sometimes inferred, with a discussion of the evidence and finally between the researcher’s opinion.
The research started with the inductive and analytical methodology by collecting the sayings that Al-Nawawi facilitated. The study concluded that Al-Nawawi was a preserver of the origins of his doctrine, as he was a jurist, and a modernist who had his own approach in reaching jurisprudential rulings and jurisprudential facilitation based on the evidence.
